GENERAL CONDITIONS OF SALE
ARTICLE 1 – PURPOSE AND IDENTIFICATION OF THE SELLER
These General Conditions of Sale govern the online purchase of the products offered by QUESOS DEL CASAR S.L. through the website www.quesosdelcasar.es (hereinafter, the “Website”).
Placing an order through the Website gives the person placing it the status of customer and implies acceptance of these General Conditions of Sale, in the version published on the Website on the date of the order.

ARTICLE 2 – SCOPE OF APPLICATION AND ACCEPTANCE
These General Conditions of Sale shall apply to all orders placed through the Website.
Before confirming the order, the customer may consult, save or print these General Conditions of Sale. Confirmation of the order by clicking the “Place order” button implies full acceptance of these terms.
QUESOS DEL CASAR S.L. may modify these terms at any time. In any event, the terms in force on the date of each order shall apply.
ARTICLE 3 – PRODUCTS, AVAILABILITY AND PRIOR INFORMATION
The Website offers for sale food products and other products related to the activity of QUESOS DEL CASAR S.L. Each product will display, as far as possible, its essential description, price, availability and other relevant information.
All offers are subject to availability. If, after an order has been placed, the requested product is wholly or partially unavailable, QUESOS DEL CASAR S.L. shall inform the customer as soon as possible and may offer an alternative solution or refund the corresponding amount.
Product images are for illustrative purposes only. Although every effort is made to ensure that the presentation, description and characteristics of the products are as accurate as possible, there may be slight non-substantial variations resulting from their nature, presentation, cutting, preparation or packaging.
ARTICLE 4 – PURCHASE PROCEDURE
To place an order, the customer must select the desired products, add them to the cart and complete the purchase process by providing the data requested in the corresponding form.
During the purchase process, the customer may review and correct any errors in the data entered before finally confirming the order.
The customer must provide truthful, accurate and complete information, especially in relation to their identity, delivery address, billing address, email address and contact telephone number.
In the event of an error in the information provided, especially in the delivery address, QUESOS DEL CASAR S.L. shall not be liable for any incidents or delivery failures arising from such error.
ARTICLE 5 – PRICES
All prices shown on the Website are expressed in euros and include any indirect taxes that may apply, unless expressly stated otherwise.
Shipping, handling or any other additional costs applicable to the order shall be indicated to the customer separately before the final confirmation of the order.
QUESOS DEL CASAR S.L. reserves the right to change prices at any time. However, the price applicable to the order shall be the price in force at the time the customer confirms it.
ARTICLE 6 – PAYMENT METHODS
Payment may be made using the methods enabled on the Website at any given time, including, where applicable, bank card and PayPal.
The customer guarantees that they are authorised to use the selected payment method and that the information provided is correct.
Card payments are processed through secure payment gateways. QUESOS DEL CASAR S.L. does not store full bank card details when payment is processed by specialised external providers.
ARTICLE 7 – ORDER CONFIRMATION AND CONCLUSION OF THE CONTRACT
Once the purchase process has been completed and the corresponding payment or authorisation has been received, QUESOS DEL CASAR S.L. shall send the customer an order confirmation email containing a summary of the purchase made.
The sales contract shall be deemed concluded when QUESOS DEL CASAR S.L. sends such order confirmation.
QUESOS DEL CASAR S.L. reserves the right not to accept an order in justified cases, such as a manifest pricing error, impossibility of supply, well-founded suspicion of fraud or lack of payment authorisation. In such case, it shall inform the customer and, where appropriate, refund any amounts paid.
ARTICLE 8 – DELIVERY AND SHIPPING TIMES
Orders shall be delivered to the address indicated by the customer during the purchase process.
As a general rule, orders placed before 3:00 p.m. on a business day shall be processed for dispatch on the same day or within the next possible operating time slot. Orders placed after 3:00 p.m. shall generally be processed and dispatched on the following business day.
Orders placed on Thursday after 3:00 p.m., as well as on the eve of holiday periods that may compromise the proper preservation or delivery of the products, may be processed and dispatched on the next available business day in order to avoid incidents arising from the goods remaining in logistics warehouses during weekends or public holidays.
Delivery times are indicative and may vary depending on the destination, product availability, logistics operations, the carrier company and circumstances beyond the control of QUESOS DEL CASAR S.L..
As far as possible, QUESOS DEL CASAR S.L. works with transport services suitable for perishable products or products sensitive to temperature. However, it shall not be liable for delays attributable exclusively to the carrier, to force majeure or to circumstances beyond its reasonable control.
ARTICLE 9 – RECEIPT OF THE ORDER AND DELIVERY INCIDENTS
The customer must check the condition of the order at the time of delivery. If they notice visible damage to the packaging, breakages, leaks, obvious missing items or any other noticeable incident, they must state this to the carrier on the delivery note or proof of delivery and notify QUESOS DEL CASAR S.L. as soon as possible.
Claims relating to visible damage, delivery errors or missing products must be sent in writing to comercial@quesosdelcasar.es, together, where possible, with photographs and any available documentation, within a maximum period of 12 hours from receipt of the order.
Claims based exclusively on subjective assessments regarding the taste, texture, appearance or freshness of the product shall not be accepted where the product conforms to its nature, descriptive information, use-by date or normal conditions of the purchased product.
ARTICLE 10 – RETURNS, WITHDRAWAL, REFUNDS AND REPLACEMENTS
In accordance with the applicable consumer protection regulations, the right of withdrawal shall not apply to contracts for the supply of goods liable to deteriorate or expire rapidly, such as the perishable products marketed by QUESOS DEL CASAR S.L..
For this reason, returns of perishable products shall not be accepted once delivered, except in the event of an error attributable to QUESOS DEL CASAR S.L., lack of conformity, proven transport damage or any other case legally applicable.
In the event of delivery of an incorrect product, shortage of product, seriously damaged product or a proven incident attributable to QUESOS DEL CASAR S.L. or to transport, the company may, as appropriate and after assessing the case, choose to:
- replace or substitute the affected product;
- make a full or partial refund of the amount paid;
- provide any other reasonable and proportionate solution according to the incident that has occurred.
Where applicable, the refund shall be made using the same payment method used by the customer, unless expressly agreed otherwise.
ARTICLE 11 – LIABILITY
QUESOS DEL CASAR S.L. shall be liable to the customer under the terms established by the applicable legislation.
The company shall not be liable for damage arising from improper use of the product, incorrect storage after delivery, failure to follow consumption or storage instructions, or facts attributable exclusively to the customer, the recipient, the carrier or third parties outside its sphere of control.
Likewise, QUESOS DEL CASAR S.L. shall not be liable for delays or failures caused by force majeure, unforeseeable circumstances, external logistics incidents, strikes, administrative restrictions, weather events, transport disruptions or any other circumstances beyond its reasonable control.
To the extent permitted by law, and unless mandatory provisions provide otherwise, the liability of QUESOS DEL CASAR S.L. shall be limited to the amount actually paid by the customer for the affected order.
ARTICLE 12 – PERSONAL DATA PROTECTION
The personal data provided during the purchase process shall be processed by QUESOS DEL CASAR S.L. for the purpose of managing the order, payment, delivery, invoicing, after-sales service and any legal or contractual obligations arising from the sale.

ARTICLE 13 – INTELLECTUAL PROPERTY AND LINKS
All Website content, including, but not limited to, texts, images, photographs, designs, logos, distinctive signs, software, structure, selection and arrangement of content, is protected by the corresponding intellectual and industrial property rights owned by QUESOS DEL CASAR S.L. or by third parties who have authorised its use.
Its reproduction, distribution, transformation, public communication, making available or any other form of exploitation, in whole or in part, is prohibited without the prior written authorisation of its owner, except in cases legally permitted.
The Website may contain links to third-party pages or resources. QUESOS DEL CASAR S.L. does not control such external sites and is not responsible for their content, availability, policies, practices or terms of use.
ARTICLE 14 – PARTIAL INVALIDITY
If any of the clauses of these General Conditions of Sale is declared null, invalid or unenforceable, in whole or in part, such nullity or unenforceability shall not affect the validity of the remaining clauses, which shall remain in force.
ARTICLE 15 – APPLICABLE LAW AND JURISDICTION
These General Conditions of Sale shall be governed by Spanish law.
In the event of any dispute or conflict arising from the interpretation, validity, performance or enforcement of these terms, the courts and tribunals having jurisdiction under the applicable regulations shall be competent. Where the customer is legally considered a consumer or user, they shall not be deprived of any rights granted to them by mandatory applicable law.
